HOUSE CONCURRENT RESOLUTION NO. 72
(By Mr. Speaker, Mr. Kiss, and Delegates Staton,
Martin, Webb, Kominar, Trump and Proudfoot)
Requesting the Joint Committee on Government and Finance to conduct
a study on the coverage of temporary employees under Workers'
Compensation.
Whereas, It is becoming increasingly common for companies and
businesses throughout the nation and this State to contract the
hiring of temporary employees, often utilizing the services of
temporary placement agencies; and
Whereas, Temporary employees so contracted are often not
included under Workers' Compensation insurance by the employing
company or business nor by the temporary placement agency, and thus
are ineligible for benefits in the event of sustaining an injury
which results in a temporary or permanent disability; and
Whereas, Temporary employees are frequently subject to the same
risk of injury and occupational hazards as are permanent employees
who are insured under the Workers' Compensation programs of such
companies and businesses; and
Whereas, Ineligibility for Workers' Compensation benefits may
cause great financial hardship and burdens in the event that such
a temporary employee receives an injury; therefore, be it
Resolved by the Legislature of West Virginia:
That the Joint Committee on Government and Finance is hereby
requested to conduct, in cooperation with the Bureau of Employment
Programs, a study of the status or the extent of coverage for
temporary employees of companies and businesses throughout the
State, especially those temporary employees who are contracted
through temporary placement agencies; and, be it
Further Resolved, That the findings and recommendations
resulting from the study shall be reported to the Legislature by
the beginning of the regular session of the year two thousand one,
together with drafts of any proposed legislation necessary to
effectuate such recommendations.
